Policy and Disclaimer
POLICY:
1) Thunder Rain Internet Publishing shall be known as "Thunder Rain" when referring to Thunder Rain Internet Publishing.
2) Our web designs are created with the "majority" of web users in mind so that the client's audience receives the best results regardless of which type of browser (IE. Netscape or MS Internet Explorer, etc.) they are operating. If a client chooses to have a site designed for the benefit of one type of browser enhancement, (IE. javascript, java, activex, etc.), additional charges may apply. This type of enhancement is not currently recommended for overall best results. Without knowing what type of browser your clients and potential clients are using, it is recommended that a web site serve the majority web users.
3) If a site is designed on the client's site (server ISP), our webmaster must be able to have access to the client's account (username and password) for proper material, updates and uploading of files. If this is not acceptable, we cannot be responsible for any problems or damage that may occur (IE. improper file format uploads (ANSI or BIN)) and will void any further maintenance/updates on clients site.
4) All web pages will be created on Thunder Rain's web site, then viewed by the client. After completion, the web pages can be transferred to client's site (server ISP) or published on Thunder Rain's web site. No web pages will be transferred until approved by client. After transfer of pages to client's site (server ISP), Thunder Rain will not be responsible for further updates unless specific arrangements have been made and approved by the Webmaster of Thunder Rain. Files will be the sole property of said client after final web pages have been transferred. Copies will be kept with Thunder Rain for further changes or updates for an undetermined time.
5) All members are entirely liable for all activities conducted through their web site. All business shall be conducted in accordance with all applicable laws, rules and regulations.
6) All members are responsible for any charges associated or connected directly with your personal site.
7) Absolutely no adult X-Rated content and/or this type of advertising is allowed on Thunder Rain's web site.
8) Thunder Rain reserves the right to change any terms of their policy at any time to take effect within 30 days after this agreement has been posted to our site.
PRIVACY:

2) Security and Customer Payment Information:
Credit card payments placed on our secure server site are encrypted using SSL technology, so rest assured that your transactions are protected. With SSL implemented on both the client and server, information sent via the Internet can be trusted to arrive privately and unaltered to our server only. In order for SSL security to work, you must use an SSL-enabled browser.
3) In compliance with the COPPA Rule - April 22, 2000.
All information submitted to Thunder Rain Internet Publishing for services and/or products are intended for customers over the age of 18 years. Any form of information submitted to Thunder Rain Internet Publishing for services and/or products by customers under the age of 18 years of age, must have prior approval from their legal guardian or parent(s) which who have the legal authority to respresent the minor customer. All request will be submitted to Thunder Rain Internet Publishing in writting and sign by the legal guradian or parnet(s) and mailed to Thunder Rain Internet Publishing prior to processing any request.
BILLING:
1) If Thunder Rain does not receive the full amount of your Thunder Rain account balance within thirty (30) days of the invoice date, an additional 1.5% (or amount applicable by law, whichever is lower) per month late charge may be added to your bill and immediately become due and payable. Clients shall be liable for all attorney and collection fees arising from Thunder Rain's efforts to collect any unpaid balance of your account(s). You agree to be billed for and pay for any outstanding balance in the event of cancellation or termination of your Thunder Rain Account. You must notify Thunder Rain within ninety (90) days after date of invoice or they will be deemed acceptable. You release Thunder Rain from all liabilities and claim of loss resulting from any error or discrepancy that is not reported to Thunder Rain within ninety (90) days of its publication.
2)All billing will take place either through the Internet via e-mail, or a hard copy invoice will be mailed to you. All service request quotes will be canceled if the required payment is not received within 15 days from the date the service quote was approved by said client. A late payment fee of $25.00 will be added to the remain outstanding balance due,if not paid within 30 days of billing invoice date.
If client decides not to proceed after commencement of work, the full deposit will be charged along with an additional rate of $90.00 per hour for work performed.
3)Any service request submitted to Thunder Rain where a customer is representing a 2nd party, the customer, the 1st party, will be legally responsible for all payments. And additional billing will be invoiced and billed to the 1st party. FULL payment is required for any services and/or products prior to commencement of services or final sale of any product provided by Thunder Rain.
REFUNDS
1) Any and all refunds are subject to processing fees and/or banking charges. These said amounts will be deducted from the agreed refunds prior to releasing of any refund agreed upon by Thunder Rain and said client.
SERVICE AGREEMENT:
1) All prices quoted by Thunder Rain for any custom design, document design, graphics, programming, text composition or editing and/or marketing pages are subject to changes without prior notice. All rates are based on the amount of pages, programming, designs, time, and size of data base. Therefore, prices vary accordingly. If additional changes are requested after programming or completion of services, additional fees may apply. Upon receipt of client's request for services, we will discuss web site construction and/or design more throughly.
2)Full payment is required if service quote is under $2000.00, for all first time customers, unless prior arranagements have been made with Thunder Rain Internet Publishing. If service quote over the amount of $2001.00 a minimum down payment of %50 is required.
If client decides not to proceed after commencement of work and/or client has approved the service quote, the full deposit will be charged along with an additional rate of $75.00 per hour for all work performed. Thunder Rain does not accept other services, free endorsements and/or free advertising in exhcange for our service fees.
3)Upon completion of requested services, if said client wishes to make their own changes, modifications or edit any programs that we (™Thunder Rain) have installed without prior notice to ™Thunder Rain, this will VOID any further maintenance agreement.
DISCLAIMER:
1) Your Internet use is solely at your own risk and is subject to all applicable local, state, national, international and foreign laws and regulations. Thunder Rain shall not be liable for any loss caused or alleged to be caused by any of its sites. This shall also apply in connection with Thunder Rain's site. Thunder Rain Internet Publishing specifically disclaims any responsibility or liability for any conduct, content, goods and services available on Thunder Rain's site or through the Internet without limitation to any part of the Internet. Thunder Rain retains the right, but not obligation, at is sole discretion and without prior notice or liability, in Thunder Rain's sole discretion to restrict and/or terminate a member's account if use violates any applicable law or regulation.
INDEMNIFICATION:
Members agree to defend, indemnify and hold harmless Thunder Rain Internet Publishing and its affiliated companies, its employees, contractors, officers, directors, telecommunications providers, ICPs from all liabilities, claims and expenses, including attorneys fees, that arise from breach of the use of or in connection with the transmission of any content on Thunder Rain's site, the Internet, members' accounts, or any web site associated with Thunder Rain.
